Given that the LOC expects this photo not to be under copyright, and that Leadbelly was a public figure, and that furthermore, the disclaimer goes on to discuss "underlying copyright" on music pieces but that this photo is not music, I think the only relevant sentence on the page is that the LOC believes the photo to be in the public domain.
